The attorney representing the individual accused of murdering his girlfriend and concealing her body in a barrel provided comments regarding the ongoing immigration hold affecting his client during a court appearance on December 16.
On Tuesday morning, the accused, Jesus Varela, was scheduled to appear in a Harris County Criminal Court. However, he was absent, and his attorney, Timothy Donahue, addressed the court on his behalf. Donahue sought a reduction of Varela’s bond, but the request was ultimately denied by the judge.
During the proceedings, Donahue also discussed the immigration hold placed on Varela, explaining how this could impact the case moving forward. He noted that Varela is currently under an ICE detainer due to federal legislation, specifically the Laken Riley Act, which imposes restrictions on the release of individuals in similar situations.
“At this particular time, I know that there’s a lot of attention to legislation that’s passed about the detention of a person, mandatory detention,” Donahue stated. “Because there’s an ICE detainer, and due to the federal statute that was enacted earlier this year, there are limitations on how much can be done to secure his release.”
In a show of empathy, Donahue expressed his condolences to the family of the victim, whose name is Ramirez. “At this point, my focus is really on offering condolences to the family of Mr. Ramirez,” he said. “However, I do intend to challenge the state to present their evidence and will request access to their full file. We’ve had productive discussions with the state as we begin to review the details of the case together.”
