AUSTIN, Texas – Attorneys representing Shane James Jr., the suspect in a devastating shooting spree, have formally notified the court of their intention to pursue an insanity defense. This announcement comes as James faces capital murder charges stemming from a violent incident in December 2023, which spanned both San Antonio and Austin.
The legal filing, submitted on September 23, is recorded in Travis County court records and follows a ruling in July 2025 that deemed James competent to stand trial. His trial is scheduled to commence on October 26, with a jury docket call set for October 20.
The December 2023 Incident
The tragic events unfolded in December 2023, beginning with the alleged murders of James’ parents, Shane James Sr. and Phyllis James, in San Antonio. Following these killings, James is accused of continuing his rampage in Austin, where he is alleged to have killed 24-year-old Sabrina Rahman and 32-year-old Emmanuel Pop Ba, as well as 56-year-old Katherine Short and her daughter, 30-year-old Lauren Short. Additionally, he reportedly shot and injured an Austin ISD police officer, an Austin police officer, and a cyclist during the course of the spree.
The shootings are believed to have started at the James family home in San Antonio, where the bodies of his parents were discovered after James was arrested on December 5, 2023. Following his apprehension, Austin police contacted the Bexar County Sheriff’s Office to request a welfare check on James’ parents, leading deputies to the grim scene.
Details of the Investigation
Upon arriving at the residence, deputies attempted to make contact with the occupants. However, after hearing noises and observing suspicious signs, they forcibly entered the home. Inside, they found evidence of violence, including blood trails leading to a blocked bathroom door. When they finally accessed the bathroom, they discovered the bodies of Phyllis and Shane James Sr., later identified through fingerprint analysis.
Evidence collected from the home included shell casings, journals, and notes affixed to the walls, which investigators believe may shed light on James’ state of mind. Family members informed authorities that James had a history of schizophrenia, exacerbated by his discharge from the Army in 2015 due to family violence.
Sequence of Events on December 5
The shooting spree in Austin began around 10:40 AM on December 5, 2023, when an Austin ISD police sergeant was shot in the leg while responding to an incident at Nelson Field. The school was placed on lockdown as law enforcement agencies converged on the scene to search for the suspect, later identified as James.
Subsequent reports indicated that James shot a handyman sitting in his car before pursuing and killing a woman who had exited her home to investigate the commotion. He then stole the handyman’s vehicle after forcing him out. Both victims succumbed to their injuries.
Later that day, police responded to a report of a burglary, where an officer was shot multiple times by James before he fled the scene, leading to a pursuit that ended with James’ arrest after a crash.
Legal Competency and Defense
Initially declared incompetent to stand trial in October 2024, James was committed to a mental health facility for treatment aimed at restoring his competency. However, by July 2025, he was ruled competent to stand trial, paving the way for the upcoming proceedings.
The court’s decision to allow an insanity defense indicates that James’ mental health will be a central issue in the trial, as his family has previously raised concerns about his deteriorating condition over the years.
